I can see the JS activity is used in ootb technical workflows, but I can't copy nor are they available in the activity panel, is there a special privilege required to be able to enable them?

JS activities are only included in system workflows.

Only the technical system admin account (in-built and only used for these OOTB workflows) can use the activity.

There is currently no possibility to use JavaScript in custom workflows

Using JS is not allowed in ACS, neither in workflows, landing pages, content blocks.

OOTB workflows are part of product feature, but JS activity is not given for making our own custom workflows hence you are not able to copy or change anything.
