Using a form twice on one page

I am looking to use the very same form twice on a single page. One is going to be in a triggered pop in window and one is in the footer. The problem I am having is that trying to submit either form does not work because it is seeing the other forms field as being empty so is throwing up the required field message on that form.

Is there a way that I can achieve this without having the cross form validation issue?
