Germany Double Opt In

Hi,

I need help in understanding Germany double opt in legal requirements for email marketing and contact management. Can anyone help?
We have 3 scenarios:
1. Users who opt in for email communication
2. Users who opt in for telephonic communication
3. Users who do not opt in but browse our website (should we track his activity? Is it legal?)

Gunjan,

I would consult with your firm's attorney or data privacy officer for the details. My understanding is that in Germany, you need to have this process:
  1. explicit opt in on the form, not pre-checked
  2. double opt in - confirming email with link to verify intent. (marketo can do this with Clicks Link in Email)
  3. Anonymous leads who visit your site will be cookied. In the EU, you must have an opt out pop up on your site, and there are several threads on this topic.

We are cosulting with Legal in Germany and every day there are new requirements:)
Just wanted to know what are the best practices on implementation from website requirements point of view.
