Does the Smart List filter "Not Filled out Form" select everyone outside of the 90 day activity period?

Hello all.  Got a question regarding the a Smart List filter against user activity, "Not Filled out Form".  Since the is a negation activity, I was concerned that all leads who may have filled out a specific form earlier than the 90 day activity period archive cut off would be included in the list.  Is that a correct assumption?

Not so sure about that. Marketo should tell us.
