Hi, has anyone had any issues that prevent the custom HTML presenting for some returning visitors. It is working for me but not for our website developer.
I'm checking their browser, making sure they are not incognito and if they have ever had the custom HTML. they have previously submitted 3 forms, so they should be adequately cookied.

Not an “issue” per se but the person needs to have First Name, Last Name, and Email Address filled for KV HTML to work.
Beyond that, we’d have to look at their browser. How are you proving that their session is associated (e.g. by including a {{lead.token}} in the page)?
