Hi all,

I am wondering just for knowledge sake, who is actually enforcing this law, and how exactly can it effect my company?

What are some best practices to make sure the emails are compliant?

Thanks!

Jodie,

There are a ton of threads on CASL and online that can give you the required detail.

If your firm has a presence in Canada, you definitely need to adhere to this law as it is the most restrictive. The Canadian Govt will enforce the law and I'm sure they will mostly do so when a complaint is made.
  • Implicit vs. Explicit consent
  • Must track time and IP of request to opt in/out
  • Almost all emails to Canadian addresses must have been opted in starting July 1, 2014
  • You can ask Canadians to opt in and if they do not, you must unsub them.
